Terms of Service

1. Agreement to These Terms
These Terms of Service ("Terms") govern your use of Optimize Teacher AI ("the Service," "we," "us"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Who Can Use the Service
You may use the Service only if:
- You are at least 13 years old.
- You have the legal capacity to enter into a binding agreement, or have permission from a parent or legal guardian if you are a minor.
- You are not barred from using the Service under the laws of your jurisdiction.
If you are using the Service on behalf of a school or organization, you represent that you are authorized to do so.
3. What the Service Does
Optimize Teacher AI is a student-built tool that produces simulated essay feedback in the style of a specific teacher. The Service uses artificial intelligence to generate predicted grades, written comments, and suggestions on essays you submit.
The Service is a study aid, not an official grading platform. Predicted grades are estimates generated by an AI model and have no academic standing. Only your actual teacher can assign a real grade.
4. Your Account
You are responsible for:
- Providing accurate information when you sign up.
- Keeping your login credentials confidential.
- All activity that occurs under your account.
Notify us promptly if you believe your account has been accessed without your permission.
5. Acceptable Use and Academic Integrity
The Service is designed to help you understand your writing, not to bypass it. You agree that you will:
- Only submit essays that you have written yourself, or that you have permission to submit.
- Use feedback from the Service the way you would use feedback from a tutor or peer reviewer — to learn and revise, not to misrepresent AI output as your own work.
- Follow your school's academic integrity policy. If your school prohibits the use of AI feedback tools on a particular assignment, do not use the Service for that assignment.
You agree that you will not:
- Submit content that is illegal, harassing, hateful, sexually explicit, or that contains the personal information of others without their consent.
- Submit another student's essay without their permission.
- Attempt to break, reverse engineer, scrape, or overload the Service.
- Use the Service to build a competing product, or to train any other AI model.
- Resell or redistribute access to the Service.
We may suspend or terminate accounts that violate this section, including by removing content or banning users.
6. AI-Generated Output
Feedback produced by the Service is generated by an AI model. It may be wrong, biased, or inconsistent. It does not reflect the actual opinions or grading practices of any real teacher, even when the Service is configured to imitate a teacher's style. We make no guarantee that predicted grades will match the grade your teacher actually assigns.
You are solely responsible for how you act on the feedback. Always exercise your own judgment, and verify important decisions with a real teacher.
7. Your Content
You keep all rights to the essays, prompts, rubrics, and other content you submit ("Your Content"). You grant us a limited, worldwide, royalty-free license to host, process, and display Your Content, solely for the purpose of operating the Service for you (for example, generating feedback, displaying your dashboard, and improving grade prediction accuracy on your account).
This license ends when you delete the content or your account, except that we may retain backups for a short period as described in our Privacy Policy.
We do not claim ownership of Your Content, and we will not use it to train any third-party AI model.
8. Our Intellectual Property
The Service itself — including its code, design, name, logo, and the prompts and rubrics we provide — is owned by us or our licensors and is protected by copyright and other laws. You may not copy, modify, or redistribute it except as expressly permitted.
9. Third-Party Services
The Service relies on third-party providers (including Supabase, Anthropic, Vercel, and Google). Where you interact with those providers directly — for example, by signing in with Google — your use is also subject to their terms. We are not responsible for the practices of third parties.
10. Beta Service and Changes
The Service is provided as an evolving student project. Features may change, break, or disappear without notice. We may add, remove, or modify features at any time.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT FEEDBACK WILL BE ACCURATE OR USEFUL.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GRADES, OR ACADEMIC STANDING, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100).
Some jurisdictions do not allow these limits, in which case they apply only to the extent permitted by law.
13. Indemnification
You agree to defend and indemnify us against any claim, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of the Service, or your violation of any law or third-party right.
14. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or if we discontinue the Service. Sections that by their nature should survive termination — including content licenses already granted, disclaimers, limitations of liability, and dispute resolution — will survive.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new "last updated" date and, where reasonable, give notice through the Service. Your continued use after changes take effect means you accept them.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there. Nothing in this section limits any rights you may have as a consumer under the laws of your home jurisdiction.
17. Miscellaneous
If any part of these Terms is held unenforceable, the rest will remain in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them in connection with a transfer of the Service. These Terms are the entire agreement between you and us about the Service.
